1. General provisions
a. These regulations set out the rules for the provision of services and sales of Products by the Seller via the Online Store operating under the domain https://iwonapodlasinska.com

b. Contact with the Seller is possible via e-mail iwonapodlasinska@yahoo.pl
c. The Regulations are addressed to both consumers (within the meaning of Article 221 of the Civil Code) and to entrepreneurs using the Online Store, provided that the individual provisions of the Regulations are not explicitly addressed only to consumers or only to entrepreneurs.
d. As part of the Online Store, the Seller provides services:
i. selling educational materials for photographers
e. All names, trademarks and designations of Products placed within the Online Store are the trademarks of their owners protected by law;
f. Information about Products placed as part of the Online Store constitutes an invitation to conclude a contract within the meaning of art. 71 of the Civil Code.
2. Definitions
a. Regulations – these regulations;
b. Seller – an entity selling Products and providing services as part of the Online Store;
c. Online Store – an online store run by the Seller via the website operating under the domain: http: //iwonapodlasinska.com
d. Online Store Services – services provided electronically to enable the sale of Products as part of the Online Store;
e. Customer – a person purchasing Products via the Online Store;
f. Service Recipient – a person who is the recipient of Online Store Services;
g. Order – Customer’s declaration of intent aimed at concluding a contract with the Seller, based on the invitation to conclude a contract presented in the Online Store;
h. Product – goods and services presented in the Online Store;
3. Online Store services
a. In order to enable the sale of Products, the Seller provides the following free Online Store Services via the Online Store:
i. processing of orders of service recipients submitted as part of the Online Store (“Order Service”);
ii. sending commercial information and providing direct marketing to recipients, with their consent (“Commercial Information”);
b. The Order Service is a one-time free service consisting of processing an order placed by the Customer via the order form available in the Online Store.
c. Commercial Information is provided free of charge to Customers only with their consent. Consent to receive Commercial Information may be made when placing orders or otherwise, in particular via the Online Store. The consent to receive Commercial Information may be withdrawn by the customer at any time, which results in the termination of Commercial Information.
d. The Service Recipient is obliged to use the Online Store Services in accordance with the law and with respect for decency. In particular, the Service Recipient has the obligation to respect the personal rights and intellectual property rights of the Seller and third parties by using the Online Store Services. The Service Provider is obliged to ensure that all data entered by him as part of using the Online Store Services are consistent with the facts.
g. If the recipient uses the Online Store Services in violation of the law or decency, in particular if the recipient enters unlawful data as part of using the Online Store Services, the Seller is entitled to delete such data and to cease providing Store Services. Internet service to the recipient.

4. Technical conditions of using the Online Store Services
a. For proper use of the Online Store Services, it is necessary:
i. The use by the Client of an end device having:
1. access to the Internet and the use of an Internet browser [Internet Exporer X.0 or higher] or another with similar or higher parameters;
2. monitor resolution – not less than [1024 × 768];
3. in the case of mobile devices, software – devices provided by the manufacturer – enabling performing operations equivalent to the above-mentioned computer browsers;
ii. Having an active address and email account;
iii. Enabling cookies on your browser;
b. The Seller, to the fullest extent permitted by law, shall not be liable for any disruptions, including interruptions in the functioning of the Online Store, caused by force majeure, unauthorized operation of third parties or incompatibility of the Online Store with the technical infrastructure of the Customer;
5. Prices
a. The prices given in the Online Store are specified in the currency chosen by the Customer – by default in Polish zlotys – and are gross prices (including VAT).
b. If the performance of the order involves the delivery of Products to the address indicated by the Customer, the final price of the Order includes – in addition to the price for the Product or service – also delivery costs, specified each time with the order, of which the Customer is informed before placing the Order.
c. In the case of Orders covering services provided for an indefinite period, the final price is the total payment for one billing period.
d. If the nature of the subject of the service does not allow, judiciously judging, to calculate the total price in advance, the manner in which it will be calculated will be notified to the Customer before placing the Order.
6. Orders
a. Placing an order is possible via the Online Store by following the instructions displayed after selecting the Products or services ordered. In order to successfully place an order, it is necessary to provide relevant data to complete the order. Before placing an Order, the Customer is required to read the Regulations and confirm that they have read the Regulations before confirming the Order. Completion of the Order will not be possible without the Customer’s confirmation of reading the Regulations.
b. When placing an Order, the Customer chooses one of the following payment methods:
ii. PayPal;
iii. Bank Transfer
c. The Online Store carries out Orders in Poland and abroad
d. When ordering Products from outside Poland, the shipping conditions are agreed individually.
e. After placing the Order, the Seller shall immediately confirm to the Customer via e-mail to the email address provided by the Customer that the Order has been received and its details, including the terms of the Order. Conclusion of a sales contract or contract for the provision of services (depending on the Product being purchased) takes place upon receipt of the confirmation by the Customer.
f. The Seller will start processing the Order within 24 hours from the time the payment is credited, and in the case of Free Products – immediately after conclusion of the contract.
g. In the case of Products sent to the Customer to the address provided by him, the Seller will ship the Product within the time specified in the description of the Product in the Online Store, in the manner chosen by the Customer when placing the Order. In the event of ordering a greater number of Products subject to shipment, the Seller will ship within the latest deadline.
h. The cost of shipping the goods is borne by the customer.
i. 6d, 6h and 6i do not apply to Products downloaded by the Customer in digital form.
j. A VAT invoice may be issued for each purchase. The proof of purchase is sent electronically. This applies only to products that are purchased from Fotografie Iwona Podlasińska. Does not apply to Video tutorials that buyers purchase from Vimeo.com
7. Products
a. In the case of Products constituting a work within the meaning of the Copyright and Related Rights Act, the Seller declares that he is entitled to offer and distribute these Products under the conditions set out in the Regulations. The use of Products may require the conclusion of an agreement with the intellectual property rights holder, on the terms set out in the agreement attached to the given Product – in this case the relevant license agreement will be made available to the customer at the Order stage.
b. In the case of Products constituting a work within the meaning of the Copyright and Related Rights Marked Act, for which it is not necessary to conclude a separate license agreement on the terms set out in point and, together with the purchase of such a Product, the seller grants a nonexclusive, perpetual, non-transferable, non-transferable license to use these Products solely for purposes related to its functions. The Customer is not entitled to sub-license, transfer the Product to third parties, lend the Product or market the Product.
c. The costs of licensing the Products covered by the license are included in the price of the Product.
d. In the case of Products that are a subscription service, using the service requires the conclusion of a subscription service contract, on the terms set out in the contract made available to the Customer when placing the Order.
e. In the case of Products delivered to the Customer in digital form, for the correct use of these Products, it is necessary for the Customer to meet the technical conditions specified in the product information, in particular having the appropriate software for which the Products are intended and the appropriate amount of disk space, in to install these Products.
8. Right of withdrawal
a. The customer who is a consumer within the meaning of art. 221 of the Civil Code, has the right to withdraw from the Agreement within 14 days from the date of the Agreement without giving the reason referred to in art. 27 et seq. Of the Consumer Rights Act.
b. withdrawal is only possible if the product has not yet been downloaded/viewed (in the case of movies) We do not accept returns when the product has been downloaded (or viewed).

9. Personal data
a. The administrator of personal data processed in connection with the provision of services within the Online Store is

b. Placing an Order is tantamount to consent to the processing of the Customer’s personal data by the Store for the purpose of processing the Order, which may involve the transfer of such data to other entities, such as payment operators.
c. The Customer has the right to inspect and modify the personal data provided by him, as well as to request that the Seller cease processing or delete his personal data.
d. The Customer’s personal data may be used for marketing purposes only with the consent of the Customer.
10. Complaints
a. All complaints regarding the Online Store Services and Products may be submitted to the following address: iwonapodlasinska@yahoo.pl
b. The Seller considers complaints within 14 days of receiving them.
c. If the complaint is not accepted, the Seller informs that the Customer who is a consumer is entitled to use the court and out-of-court dispute resolution methods, in particular, to report the disputed case to poviat or municipal consumer ombudsmen in the Republic of Poland or to use the amicable dispute resolution platform under European Union, available at http://ec.europa.eu/consumers/odr/.
11. Final provisions
a. For customers who are not consumers within the meaning of art. 221 of the Civil Code, settlement of disputes is subject to the court having jurisdiction over the registered office of the Seller.
b. For customers who are not consumers within the meaning of art. 221 of the Civil Code, in matters not covered by the Regulations, the relevant provisions of Polish law shall apply.
